The European Commission lists e-books among the covered services, so any publisher selling ebooks to EU consumers is in scope, wherever the publisher is based.

Enforcement is national. Each Member State designates its own authorities and sets penalties, so procedures and fines vary by market.

Annex I of the Directive sets six e-book requirements. They cover synced text and audio, assistive technology support, navigation and layout, alternative renditions, accessibility metadata, and DRM that leaves accessibility features working.

Backlist timing is not uniform. The Directive does not name the backlist. France gives titles published before 28 June 2025 until 28 June 2030, while other countries apply the rules to new and existing titles alike.

The practical target is a reflowable EPUB 3 that meets EPUB Accessibility 1.1 at WCAG Level AA, with schema.org accessibility metadata and an honest conformance claim.

Triage before you remediate. Sort titles by EU sales exposure, source file condition and content richness, then fix them in waves.

The European Accessibility Act for publishers is no longer a future deadline. It has applied to ebooks sold in the EU since 28 June 2025. Most production teams have moved new titles to born-accessible workflows. The harder problem is the catalog that already exists: thousands of EPUB 2 files, fixed-layout titles and PDF-only editions built before accessibility was part of the brief.

This guide answers the questions European Accessibility Act publishers bring to us most often. It covers what the law requires, who is exempt and how backlist timing differs by country. It then shows how to triage, cost and fix the backlist in a sensible order.

Need a fast read on your files? Send 3 sample titles for an accessibility audit and we will map each one to a remediation lane.

What does the European Accessibility Act require for ebooks?

The EAA requires ebooks sold to EU consumers to work with assistive technology. Files must offer accessible navigation, structure and flexible layout. They must allow alternative renditions, sync text with any audio, describe their accessibility in metadata, and keep DRM from blocking accessibility features. These rules sit in Annex I, Section IV(f), of Directive (EU) 2019/882.

The Directive defines “e-book and dedicated software” as a service (Article 3(41)). It covers the digital files that carry an electronic version of a book, plus the software used to read them. E-readers are covered separately as products. Per Article 31, Member States had to apply their national rules from 28 June 2025.

Here are the six e-book requirements from Annex I, Section IV(f), in plain terms:

Synced text and audio. If an ebook contains audio as well as text, the two must be synchronized.

No blocking of assistive technology. The file must not stop screen readers and other tools from working properly.

Navigable content and layout. Readers need access to the content, navigation, structure and dynamic layout, with flexibility in how content is presented.

Alternative renditions. Content must allow alternative renditions and work with a range of assistive technologies.

Discoverable accessibility. Accessibility features must be described in metadata.

DRM that does not block accessibility. Rights-management measures must not disable accessibility features.

Two more duties apply to the service as a whole. Under Article 13 and Annex V, you must publish information explaining how your service meets the requirements. If a title is non-compliant, you must take corrective action and inform the competent national authority. In practice, this means an accessibility statement, plus records you can produce on request.

Who enforces the European Accessibility Act?

Enforcement is national, not central. Each Member State has written the Directive into its own law and designated authorities that check whether services comply. The Directive also requires Member States to set penalties that are effective, proportionate and dissuasive, so fines and procedures differ from country to country. At EU level, the European Commission monitors whether the Act has been transposed completely and correctly, runs an expert group that includes national market surveillance authorities, and supports implementation through AccessibleEU. For a publisher, your exposure depends on the markets you sell into.

In short: the EAA covers the file, the metadata that describes it and the way it is sold. Fixing only the HTML inside the EPUB is not enough.

European Accessibility Act for publishers: who is covered, and who is exempt?

Any publisher that provides ebooks to consumers in the EU is covered, including US, UK and Indian publishers selling through EU storefronts. Micro-enterprises providing services are exempt from the service requirements. The Directive defines a micro-enterprise as having fewer than 10 staff and annual turnover or balance sheet total of no more than EUR 2 million.

The exemption sits in Article 4(5), and the definition in Article 3(23). Two cautions apply. First, the exemption covers the micro-enterprise itself, not its distributors. Retailers, aggregators and library platforms may still require accessible files and metadata to accept a title. Second, the test combines headcount with turnover or balance sheet, so check both before you rely on it.

Larger publishers have two narrower routes, both under Article 14:

Fundamental alteration. Compliance would change the basic nature of the product or service.

Disproportionate burden. Compliance would place a disproportionate burden on the business, assessed against the criteria in Annex VI.

Both routes need a documented assessment. You must keep it for five years after the service was last provided and renew it at least every five years. You must also notify the relevant authorities when you rely on these routes (micro-enterprises are excused from that notice). You cannot claim disproportionate burden if you received outside funding to improve accessibility. These are title-by-title judgments, not a blanket opt-out for the backlist.

In short: assume you are covered unless you are genuinely a micro-enterprise, and treat any burden claim as paperwork you will need to defend.

Does the EAA apply to backlist ebooks published before June 2025?

Backlist ebooks still on sale are generally in scope, but timing depends on the country. The Directive covers services provided to consumers after 28 June 2025 and never mentions the backlist. France gives earlier titles until 28 June 2030. A 2024 DAISY review found Finland and Denmark apply the rules to new and existing titles alike.

Much of the confusion comes from Article 32. It requires Member States to allow a transition period ending 28 June 2030, during which service providers may keep using products they lawfully used before that date. It also lets service contracts agreed before 28 June 2025 continue unchanged until they expire, for up to five years. Neither sentence mentions ebooks or backlist titles, so readings differ.

Another frequent mix-up involves Article 2(4). That clause exempts certain website and mobile app content, such as office file formats published before 28 June 2025 and archived web content. It is about websites and apps. It is not a backlist exemption for ebooks.

National rules are where the answer gets concrete. Here is what is clear as of October 2026, and what remains open.

Question

What is clear

What is still open

New titles (front list)

Ebooks provided from 28 June 2025 must meet the requirements.

Little debate. Build them born-accessible.

Backlist in France

France’s Ministry of Culture says titles already published are covered from 28 June 2030.

How regulators will treat titles that are re-released or updated in the meantime.

Backlist elsewhere in the EU

The Directive itself does not carve out the backlist.

Member States differ. A 2024 DAISY review found Finland and Denmark apply the rules to existing titles; Sweden’s position was less clear.

Article 32 “2030” transition

It covers products used to provide services and pre-June 2025 service contracts.

Whether it extends to backlist ebook files. Case law may settle this over time.

The DAISY Consortium’s review of regional differences reached the same conclusion: the backlist grace period question is likely to be resolved through case law over a matter of years. DAISY’s advice, and ours, is to act now rather than wait for that answer.

Take a US or UK publisher selling across the EU. The cautious plan is to treat any backlist title on active EU sale as in scope today. Use national transitions, where they exist, to schedule the work, not to defer it.

In short: the front list is settled. For the backlist, check the rules in each market you sell into, and plan as though the strictest reading applies.

What do EPUB Accessibility 1.1 and schema.org accessibility metadata require?

EPUB Accessibility 1.1 is the W3C Recommendation, published 25 May 2023, that defines when an EPUB counts as accessible. It requires WCAG 2 conformance at Level A as a minimum and strongly recommends the latest WCAG 2 at Level AA. It also requires schema.org accessibility metadata and a formal conformance statement in the package document.

The EPUB Accessibility 1.1 specification itself notes that laws such as Directive 2019/882 require more than Level A. That is why WCAG AA is the working target for EAA ebook compliance. EN 301 549, the European ICT accessibility standard, was updated to V4.1.1 in September 2026 and aligns with WCAG 2.2 Level A and AA. As of September 2026, legal commentators noted that its presumption of conformity under the EAA depends on citation in the EU’s Official Journal. To build to that target, our accessible EPUB 3 conversion team produces reflowable files, and our WCAG 2.2 AA testing and remediation service checks them against the standard.

Required and recommended metadata

Every EPUB must carry three schema.org properties. This applies even if the file does not meet the full specification.

accessMode: the senses needed to use the content, such as textual or visual.

accessibilityFeature: features such as alternative text, structural navigation, page navigation or MathML.

accessibilityHazard: hazards such as flashing, motion simulation or sound, or a statement that there are none.

Two more are recommended. accessibilitySummary is a plain-language note that includes known gaps. accessModeSufficient lists the combinations of senses that are enough to read the book without losing information.

The EPUB accessibility conformance claim

To claim conformance, the package must include a
dcterms:conformsTo
value that matches the specification’s pattern exactly, in case and spacing. An example is
EPUB Accessibility 1.1 - WCAG 2.1 Level AA
. It must also include an
a11y:certifiedBy
property naming the organization that evaluated the file.

Claim only what the file achieves. A file that declares alternative text when its images carry filenames as alt text is making a false statement. That is worse than an honest summary that names a known gap.

Mirror the same facts in your ONIX feed so retailers and library platforms can display them. Metadata only helps readers if it reaches the storefront.

How should publishers triage an EPUB backlist?

Triage the backlist with a simple scoring pass before anyone edits a file. We use a four-part model called SORT: Sales exposure, Origin file, Richness and Treatment lane. It ranks titles by EU revenue risk, then by how hard each file is to fix. The result is a wave plan instead of an open-ended project.

The SORT triage turns a backlist into ranked, lane-based remediation waves.

S: Sales exposure

List every ISBN that is on sale, or available for library lending, in the EU. Rank titles by EU revenue, the channels that carry them, and institutional demand. High-exposure titles go first because they carry the most commercial and compliance risk.

O: Origin file

Record the best source you hold for each title. That might be a clean EPUB 3, an EPUB 2, a fixed-layout EPUB, or only PDF and print files. The source format often decides whether you remediate or reconvert. If a title exists only as a PDF, our guide to converting PDF to EPUB covers the reconversion path.

R: Richness

Count what makes a file hard: images, complex tables, equations, audio, sidebars and fixed layouts. The ABE Lab project’s gap analysis, reported by Fondazione LIA, tested 376 backlist ebooks from seven EU countries. Accessibility metadata was missing in 100% of files and alt text in 83%. The hardest genres were those with complex structures and layouts, such as science, medicine and language books.

T: Treatment lane

Assign each title to one of four lanes:

Lane A, metadata and quick fixes. Clean EPUB 3 prose titles that mainly need metadata, language tags and a short image review.

Lane B, targeted remediation. Sound files that need alt text, heading structure, table markup and page navigation.

Lane C, reconversion. PDF-only, scanned or badly built files where rebuilding the EPUB is cleaner than patching it. Our ePublishing and ebook creation team handles this kind of rebuild.

Lane D, assess burden or withdraw. Low-selling, high-effort titles where you document an Article 14 assessment or pull EU sale.

Then ship in waves. Batch titles by lane, validate with EPUBCheck and DAISY’s Ace checker, test with screen readers, and refresh metadata feeds. Treat a failed validation as a release blocker.

Want the SORT model as a working file? Ask us for the SORT backlist triage worksheet, or send 3 sample titles and we will score them for you.

What drives the cost of remediating a backlist title?

Per-title effort depends mainly on the source file, image volume and type, tables, math, layout, media and metadata feeds. A clean EPUB 3 novel may need only metadata and a brief review. A PDF-only STEM textbook with diagrams and equations usually needs full reconversion, expert alt text and MathML, which multiplies effort.

We do not publish per-title prices, because two books with the same page count can differ several-fold in effort. Use this table to estimate where each title will fall before you request quotes.

Cost driver

Low effort

Medium effort

High effort

Source file

Clean reflowable EPUB 3

EPUB 2 or poorly built EPUB 3

PDF only or print files

Images

Few, or decorative only

Photos and simple charts

Dense diagrams, maps and figures

Tables

None

Simple data tables

Complex tables or tables saved as images

Math and notation

None

Occasional equations

STEM content that needs MathML

Layout

Linear prose

Boxes, sidebars and callouts

Fixed layout, comics or picture books

Audio and media

None

Short embedded clips

Read-along text and audio sync

Metadata and feeds

Package metadata only

Package plus ONIX update

Several editions and distribution feeds

QA depth

Automated checks plus spot review

Full screen-reader pass

Screen-reader pass plus subject expert review

Rate each title on these eight drivers to place it in a SORT lane before quoting.

Images are usually the biggest swing factor in educational and STEM titles. Writing alt text for a chemistry diagram or a statistics chart takes subject knowledge, not just a tool. Our sibling guide on alt text for STEM images covers that work in detail.

Fixed-layout titles deserve a frank conversation. ABE Lab noted that some graphic-led books may not reach every requirement, even with current techniques. For these, the realistic options are a reflowable edition, an honest accessibility summary, or a documented burden assessment.

How do you choose a backlist ebook remediation vendor?

Choose a vendor that audits sample titles before quoting and targets EPUB Accessibility 1.1 at a stated WCAG level. It should use subject experts for alt text and handle MathML and tables properly. We have served 350+ global clients, with 700+ experts and more than 2 million digital assets delivered. We are ISO 9001 certified. Our accessibility remediation services and EPUB conversion services run as one backlist workflow:

Sample audit. We test titles from each likely lane against EPUB Accessibility 1.1 and WCAG AA.

SORT plan. We score the list and propose remediation waves by lane.

Remediation or reconversion. We fix structure, navigation, alt text, tables, MathML and language tags, or rebuild the EPUB where that is cleaner.

Metadata. We write schema.org accessibility metadata, the conformance claim and an honest summary, ready for ONIX.

Four-stage QA. Every title moves through content creation, internal review, client review and final delivery.

For publishers that want wider production support, our publishing solutions cover editorial and digital production around the remediation work. Member States had to write it into national law by June 2022, and the accessibility requirements have applied since 28 June 2025. Ebooks provided to EU consumers from that date must meet them.

Who enforces the European Accessibility Act, and what are the penalties?

National authorities in each EU Member State. Each country designates the bodies that check services and sets its own penalties, which the Directive requires to be effective, proportionate and dissuasive. Amounts and procedures therefore vary by market. The European Commission monitors transposition but does not fine publishers directly.

Are small publishers exempt from the European Accessibility Act?

Only micro-enterprises that provide services: businesses with fewer than 10 staff and annual turnover or balance sheet total of no more than EUR 2 million. Small and medium-sized publishers are covered. Even exempt micro-enterprises may find that retailers and library platforms require accessible files and metadata.

Do publishers need an accessibility statement under the EAA?

Yes. Service providers must publish information explaining how their service meets the accessibility requirements, as set out in Annex V of the Directive. For ebooks, that usually means a public accessibility statement plus accurate accessibility metadata for each title.

Frequently asked questions

Does the European Accessibility Act apply to US and UK publishers?

Yes, if they provide ebooks to consumers in the EU. The Directive applies to services offered on the EU market, regardless of where the publisher is based. A US or UK publisher selling through EU storefronts or library platforms should plan for compliance. Its home-country laws, such as the ADA or the UK Equality Act, apply separately.

Are backlist ebooks exempt from the EAA until 2030?

Not across the whole EU. The Directive does not name backlist titles. France gives ebooks published before 28 June 2025 until 28 June 2030, while a 2024 DAISY review found that Finland and Denmark apply the rules to existing titles too. Check each market you sell into, and prioritize high-selling backlist titles now.

What is EAA ebook compliance in practice?

In practice, most publishers aim for a reflowable EPUB 3 that meets EPUB Accessibility 1.1 at WCAG Level AA. That means correct structure and reading order, alt text, and accessible tables and math. It also means a declared language, schema.org accessibility metadata, a conformance claim, and DRM that does not block assistive technology.

Which WCAG version should our EPUB conformance claim use?

EPUB Accessibility 1.1 accepts WCAG 2.0 or later, at Level A or above, and recommends the latest version at Level AA. EN 301 549 V4.1.1, published in September 2026, aligns with WCAG 2.2. Many publishers now build to WCAG 2.2 AA and claim only the version and level each file actually meets.

Can fixed-layout ebooks meet EAA requirements?

Partly. Fixed-layout titles can gain semantic markup, reading order, alt text and metadata, but some requirements, such as text reflow, are hard to meet. Options include a reflowable edition, an accessibility summary that names known gaps, or a documented disproportionate burden assessment under Article 14.

What happens if a backlist title cannot be fixed economically?

You can document a disproportionate burden assessment under Article 14, using the Annex VI criteria. You must keep it, renew it at least every five years and notify the authorities. Alternatively, you can withdraw the title from EU sale. Do not rely on burden for titles with meaningful EU sales.

How long does backlist ebook remediation take?

It depends on volume and lane mix.
